Yolanda Bergel Sainz de Baranda

Professor of Civil Law at Universidad Carlos III de Madrid

Art Law has been Yolanda Bergel’s field of expertise since she started her career at the university in 2000. Her thesis for the doctoral degree in Law regarded the contract of sale of works of art. It obtained an extraordinary price in 2009 and was published in 2011. The Sale of works of art. Private Law problems (in Spanish) is a reference book in Spain in matters of authenticity, remedies in the sales of works of art, the particularities of auction sales and the repercussion of the export and import rules and other cultural heritage provisions in private sales.

Yolanda is the Director of an expert title in Art Law at Universidad Carlos III de Madrid, which is the first university title in the subject in Spain. Art Law is her main field of research (alongside digital contracts and digital services, consumer protection and Tort Law). She has published extensively on this topic and has participated in conferences both in Spain and abroad. She teaches different subjects regarding art sales and art loans at the Master in IP and the Master in Cultural Management at UC3M. In 2019, she received by the unanimous decision of the jury the prestigious Rodrigo Uría Meruéndano Award in Art Law for the paper "Export of works of art. Legal regime and criteria to decide on the concession of export licences. A proposal of lege ferenda".

Yolanda’s educational background includes a Doctor Honoris Causa by Örebro Universitet, Sweden (2014); Doctoral Degree: 2008, March 14. Doctor of Laws (LLD), cum laude. Title of the Thesis: The sale of works of art. Private Law problems. Supervisor: Professor Dr. Jorge Caffarena Laporta; Doctorate studies in Private Law. Universidad Carlos III de Madrid (1998-2000); LL.M in International Business Law, with honours. King´s College London (1993-1994); European Community Law Diploma, Universidad San Pablo CEU, Madrid (1989-1993); Bachelor of Laws, Universidad San Pablo CEU (1988-1993).

Yolanda’s professional experience includes: Professor of Civil Law at Universidad Carlos III de Madrid (UC3M), Department of Private Law, Faculty of Law and Social Sciences (2000-present); Lawyer at the Commercial Law Department, Uría Menéndez (1994-1998).
